The ERISA Gremlin and Health Care

Once upon a time, if a lawyer emerged victorious in a settlement, a client could be told exactly what the victory would net him/her after fees, costs, and liens. A clear distinction existed between those liens that had to be paid back and those that didn’t. Some government liens were statutorily required to be paid back, while all other private liens were prohibited. Enter ERISA.

If ERISA were human, she’d be an ex-girlfriend of death. In fact, the Employee Retirement Income Security Act and the cases interpreting it introduce a dust storm of arcane legal doctrine and ambiguity to the question of what liens must be paid back. Legal questions dot the fur like fleas on your pet. Which health plans and disability plans are promulgated pursuant to ERISA? Which of those ERISA plans are self-funded and thus entitled to federal preemption of state anti-subrogation statutes? Does the request for reimbursement meet the requirements of equitable restitution or is it merely a claim for money damages? What is the lawyer’s obligation under rules of ethics?

Franklin D. Roosevelt once said, “You have nothing to fear but fear itself.” In fact, ERISA collection agents utilize fear to claim an entitlement to a client’s settlement money.

The reality is quite different. The universe of liens that preempt state anti-subrogation statutes is tiny. The plan must be promulgated under ERISA, and must fully self-fund all medical expenses incurred by its plan participants. If the plan is operated by a commercial insurer some portions of state law are still applicable – thus anti-subrogation statutes can apply even if self-funded.

Only the expenses actually paid by the plan compel preemption of anti-subrogation law in many states. Lawyers should ask questions when ERISA comes calling. Is the plan really ERISA? Is it self-funded? How much is it self-funded? Is the government paying? What do the agreement and the contracts say about third-party recoveries?

Lawyers can do better for their settlement clients. In most cases, a time of celebration shouldn’t have to culminate as the Grim Reaper’s Ball.

Alternative Health Plan Debate

Many people are pretty polarized on the alternative health care debate. They are either completely for or completely against it. On the one hand, there are people who stand with tradition entirely and are unwilling to compromise. They believe that normal medical health is the highest level that the treatment of diseases has ever reached. They don’t believe in any alternative health treatment at all, viewing it as unscientific and probably unhelpful as well.

On the other hand, there are alternative health fanatics. I know some people who will only use holistic health services and nothing else. They won’t even take prescription drugs if they believe they can get better with herbs. They believe that science is overrated and that some things can’t be measured in numbers.

I always try to avoid either extreme in my own practices. I have had some great success with alternative health, and definitely wouldn’t give it up. On the other hand, I think that science is very valuable. Traditional Western medicine has done a lot of great things for us. It has brought us a new understanding of the physical body, excellent drugs and treatment options, incredible scans which allow us to see inside the body, and many other helpful technologies. To throw it all away based on a vague belief in the power of herbs is foolish.

That is why I use both alternative healing and traditional medicine. I think that improving your diet and taking health supplements can do great things for you, and is often a better solution than costly medications with side effects. When you are not treating something severe and acute, you shouldn’t put a lot of stress on your body during the treatment. Otherwise the cure can be worse than the illness. Using herbal treatments can remove the need to strain your body by introducing antibiotics and things like that into it.

On the other hand, I like to keep traditional medicine as an option. Sometimes, things get really bad and you just need a pretty strong treatment. You might not want to start with an operation or even prescription medication, but it might come to that in the end. This is why I have always viewed complimentary medicine as the best approach. It allows you to use both Western and Eastern medicine, combining the best of both worlds. After all, the more tools you have, the more options you have for treatment.

health benefits companies compete for your business.

Although there is no “best” health benefits plan, there are carriers that are a better fit than others for your business and your employees’ health care needs.

Evaluating cost

Business owners are searching for ways to reduce their health care expenses. Look for a carrier that administers your health benefits plan efficiently.

Administrative charges are a carrier’s overhead costs. They are included in your premium and can vary significantly. These charges include processing and paying claims, answering
customer calls, marketing and advertising costs, and broker commission payments. Carriers with lower administrative costs usually are much more affordable than those with high administrative costs. When reviewing proposals from health
benefits companies, ask what they will charge you for administrative expenses.

Offering employees a choice

Giving employees the freedom to choose their health plan will help educate them about the valuable benefit you offer, satisfy
their need for health benefits and keep your premium contributions within your budget. Plan choices may vary by co-payment, network access and employee contribution. It will be the employee, not the employer, who is responsible for evaluating and choosing his or her health benefits plan.

Employees will have to determine how often they use health care services, what they estimate those costs to be and how they want
to access and pay for those services.

An adequate provider network

No health benefits plan covers every health expense an employee may have or includes every physician. You are purchasing group
coverage. As a business owner, you must evaluate whether the health benefits pIan you are considering offers an affordable level of benefits and a network that provides adequate
accessibility for your employees.

Your bottom line

In South Florida, there can be as much as a 15 percent difference in cost among the health benefits companies you have to choose from. The health plan you select should be cost-competitive and offer a choice of health plans and an extensive provider network to meet the needs of your group.

Whether your company has 20 employees or 1,000, your level of engagement in the decision-making process is vital in determining how health care costs will impact your company’s
bottom line. Standing on the sidelines could be a price you cannot afford to pay.
